In 2020, during the sales process, our company discovered that Zhejiang Zheng'an Explosion-proof Electrical Co., Ltd. produced and sold a model specification DGC22/127L (A) mining explosion-proof LED bracket light, which has the same appearance as the design patent for the mining explosion-proof light (application number CN306034899S) that our company applied for at the National Intellectual Property Administration on February 8, 2020, and was officially announced on September 4, 2020, with the patent certificate number ZL2020300480912 valid for ten years. The production, sale, and promise of sale of products that infringe on our design patent rights without our permission constitute an infringement of our rights.
Our company sent letters to Zhejiang Zheng'an Explosion-proof Electrical Co., Ltd. on January 26, 2021, and April 1, 2021 (see attachments 1 and 2), demanding that they immediately stop the production, sale, and promise of sale of the aforementioned infringing products. On May 10, 2021, Zhejiang Zheng'an Explosion-proof Electrical Co., Ltd. applied to the National Intellectual Property Administration for a patent invalidation request. The National Intellectual Property Administration held an oral hearing on August 18, 2021, and ultimately decided to maintain the validity of the design patent ZL2020300480912 (see attachment 3).
In response to this infringement case, our legal, technical, and administrative departments, along with relevant personnel, actively investigated and collected evidence before the case hearing. During the hearing, we argued vigorously based on the facts, ultimately safeguarding the legitimate rights and interests of Tanso Optoelectronics, enhancing the distinctiveness of the "Tanso" trademark, and demonstrating our company's firm determination and persistent action in advancing the path of intellectual property protection.
